By accessing or using the website of Increative Solutions (located at increativesolutions.com) or by engaging any of our services, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions ("Terms").

If you do not agree to these Terms, please do not use our website or services. These Terms apply to all visitors, users, and clients who access or use our services.

Increative Solutions provides the following technology and digital services:

• Custom Software Development
• Web Development (static websites, web applications, e-commerce)
• Mobile App Development (Android, iOS, cross-platform)
• Artificial Intelligence & Automation Solutions
• Machine Learning Model Development
• Data Analytics & Business Intelligence
• Publication Support Services
• Professional Ebook Writing

All services are provided on a project basis, and specific deliverables, timelines, and pricing are agreed upon via a written project proposal or service agreement prior to commencement. We reserve the right to modify or discontinue any service at any time.

To engage our services, you must:

• Be at least 18 years of age.
• Have the legal authority to enter into binding contracts.
• Provide accurate and complete information during the enquiry and onboarding process.
• Not be located in a country under trade sanctions or restrictions that would prohibit engagement with a Pakistan-based company.

By engaging our services, you represent and warrant that you meet all the above eligibility requirements.

The following payment terms apply to all engagements with Increative Solutions:

• Advance Payment: Projects typically require a deposit of 30–50% of the total project cost before work commences. The specific percentage will be stated in the project proposal.
• Milestone Payments: For larger projects, payments are structured around agreed milestones. Payment for each milestone is due upon delivery of the corresponding deliverable.
• Final Payment: The remaining balance is due before final delivery and handover of all project files and assets.
• Payment Methods: We accept bank transfer, JazzCash, EasyPaisa, and internationally via agreed platforms. All applicable details will be provided in the invoice.
• Late Payments: We reserve the right to pause work on any project where payment becomes overdue by more than 7 days. A late fee of 2% per month may be applied on outstanding amounts.

All prices are quoted in USD unless otherwise stated. Currency conversion for PKR or other currencies will be applied at the prevailing rate on the invoice date.

Client-Commissioned Work: Upon receipt of full and final payment, ownership of the custom deliverables (source code, designs, written content) created specifically for a client project is transferred to the client.

Pre-Existing IP: Any tools, frameworks, libraries, methodologies, templates, or reusable components developed by Increative Solutions prior to the project and used in delivering services remain the sole intellectual property of Increative Solutions. The client is granted a non-exclusive, perpetual licence to use these within the delivered project.

Website Content: All content on this website — including text, graphics, logos, and source code — is the property of Increative Solutions and protected under applicable copyright law. You may not reproduce, copy, or distribute any content without express written permission.

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the engagement. This includes but is not limited to:

• Business strategies, financial data, and internal processes shared by the client.
• Unreleased product concepts, features, or intellectual property.
• Any data explicitly marked as "Confidential" or reasonably understood to be so.

This confidentiality obligation survives the termination of any service agreement and remains in effect for a period of 2 years thereafter, unless a separate NDA is agreed with a different term.

You may not use our website or services for any of the following purposes:

• Any activity that is unlawful under Pakistani law or applicable international law.
• Developing software, applications, or systems intended to facilitate fraud, cybercrime, hacking, or unauthorised access to systems.
• Creating content that is defamatory, obscene, hateful, threatening, or invasive of another's privacy.
• Distributing malware, spyware, ransomware, or any other harmful code.
• Engaging in money laundering, terrorist financing, or any activity that violates financial regulations.
• Selling, distributing, or promoting illegal goods or controlled substances.
• Infringing upon the intellectual property rights of any third party.
• Collecting or misusing personal data of third parties without proper consent.
• Using our services to develop products that would compete directly with Increative Solutions without prior written agreement.

Increative Solutions warrants that:

• Services will be delivered with reasonable skill, care, and professionalism.
• We have the right to provide the services described and are not bound by any agreement that would prevent fulfilment of our obligations.
• Deliverables will substantially conform to the agreed project scope as documented in the project proposal.

We offer a 14-day post-delivery bug fix period for technical projects (software, web, and mobile), during which we will correct any defects that arise from our implementation — provided these are not caused by client-side modifications, third-party integrations, or changes in requirements.

We do not warrant that our services will be error-free or completely uninterrupted, nor do we make any guarantee of specific business outcomes arising from the use of our deliverables.

To the fullest extent permitted by applicable law, Increative Solutions shall not be liable for:

• Any indirect, incidental, consequential, or punitive damages arising from the use or inability to use our services.
• Loss of profit, revenue, data, or business opportunity, even if we have been advised of the possibility of such damages.
• Damages caused by third-party service failures (hosting providers, payment gateways, APIs, etc.).
• Losses arising from the client's failure to maintain backups of their data or systems.

Our total aggregate liability to any client for any claim arising under or in connection with a service engagement shall not exceed the total fees paid by that client for the specific project in the 3 months preceding the claim.

Either party may terminate a service engagement by providing written notice. In the event of termination:

• The client will be invoiced for all work completed up to the termination date.
• Any advance payments will be reconciled against the value of completed work.
• Increative Solutions will deliver all completed work files to the client within 5 business days of receiving final payment.

Increative Solutions may terminate an engagement immediately and without notice if the client is found to be in breach of these Terms, particularly the Prohibited Use clause.

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Karachi, Sindh, Pakistan.

International clients agree to submit to Pakistani jurisdiction for dispute resolution purposes, without prejudice to their right to seek enforcement in their local jurisdiction as may be applicable under international law.

Increative Solutions reserves the right to update or modify these Terms at any time. Changes will be posted on this page with a revised "Last Updated" date. It is your responsibility to review these Terms periodically.

Your continued use of our website or services after any changes constitutes your acceptance of the revised Terms. If you disagree with any updated Terms, please discontinue use of our services and notify us in writing.
